Terms of sale

1. Purpose and scope

These terms of sale govern the sale of a usage license for the Scope Photo Viewer software ("the Software"), a macOS desktop application, by Endemic Kft ("the Seller", see legal notice) to any individual or legal entity ("the Customer") making a purchase on scope-photo-viewer.com. Placing an order implies unreserved acceptance of these terms.

2. Product

The license sold is a perpetual, non-exclusive, non-transferable usage license for the Software, activatable on a single device at a time. The Customer may unbind a device and activate another at any time from their "My account" area, self-service, without needing to contact support.

3. Price and payment

The price shown at the time of order is a one-time price (no subscription), including all applicable taxes. Payment is made online, by card, via Stripe (a third-party payment provider) — the Seller never collects or stores the Customer's card details. The order is only confirmed once payment has actually been confirmed by Stripe.

Purchasing does not require creating an account beforehand: an account (Google sign-in or magic link by email) simply lets you retrieve your license key later from any device.

4. Delivery

The license (an activation key) is delivered immediately after payment confirmation, electronically. The Software itself is downloadable free of charge from the site; the key unlocks full use.

5. Right of withdrawal

Under EU regulations applicable to digital content not supplied on a physical medium, the Customer is in principle entitled to a 14-day withdrawal period from the date of purchase. However, this right of withdrawal does not apply — and the Customer is informed of this and gives their express agreement at the time of order — once performance of the contract (immediate delivery of the license key) has begun with their prior express consent and express waiver of their right of withdrawal.

In practice: by confirming their order, the Customer expressly requests immediate delivery of their license key and acknowledges losing their right of withdrawal from that delivery onward.

6. Legal warranties

The Seller remains bound by the legal warranties applicable (conformity, hidden defects) under the law applicable to the Customer as a consumer. These legal warranties apply regardless of any commercial warranty and are in no way limited by these terms.

7. Liability

The Software is provided "as is". The Seller cannot be held liable for indirect damages resulting from use of the Software, nor for data loss resulting from mishandling by the Customer (the Software manipulates files already present on the Customer's computer — see the privacy policy for details on data processed).

8. Personal data

The processing of the Customer's personal data in connection with an order is described in the privacy policy.

9. Applicable law and disputes

These terms are governed by Hungarian law, without prejudice to mandatory consumer protection provisions applicable in the Customer's country of residence where the Customer is a consumer. In the event of a dispute, the Customer may use a consumer mediation procedure or the EU online dispute resolution platform before any legal action.
